FORECLOSURE SALE
CHILTON COUNTY, ALABAMA
Default having been made in the payment of the indebtedness secured by that certain mortgage given by Michael C. Cain and Madisen Cain, husband and wife to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Cardinal Financial Company, Limited Partnership, dated July 25, 2022, and recorded in Book 2022 at Page 248151 on August 25, 2022, in the Office of the Judge of Probate of Chilton County, Alabama, as last transferred to Data Mortgage Inc., dba Essex Mortgage by assignment, recorded on January 13, 2026, in Book 2026, at Page 272344 in the Office of the Judge of Probate of Chilton County, Alabama, conveying the after-described property to secure a Note in the original principal amount of One Hundred Forty-Nine Thousand Two Hundred Forty-Six and 0/100 dollars ($149,
246.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on July 7, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Chilton County, Alabama, within the legal hours of sale, the following described property:
A lot or parcel of land lying across the West side of Lot 6 of the Crumpton Estates Subdivision as per map or plat of said subdivision recorded in Map Book 4 at page 158 in the Office of the Judge of Probate of Chilton County, Alabama. From the Northwest corner of Lot 6 run East along the North line of said lot a distance of
23.2 feet to a chain link fence; thence run Southwest along said fence to a point on the North line of a paved public street and the South line of Lot 6; thence Westerly along said South right of way line a distance of 10 feet, more or less, to the common corner of the SE corner of Lot 5 and the Southwest corner of Lot 6, from said point run thence North along the common line between Lot 5 and Lot 6 of said subdivision a distance of 139 feet to the point of beginning. ALSO, Lot No. 5 of the Crumpton Estates Subdivision of the Town of Thorsby, Alabama, map or plat of which is recorded in the Office of the Judge of Probate of Chilton County, Alabama, in Map Book 4 page 158.

The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
